  35. SUMMARY: This action proposes to amend the rules for the amateur 
  36. service by modifying the Commission's compliance policy for 
  37. stations participating in message forwarding and voice repeater 
  38. systems. This action addresses six petitions for rulemaking 
  39. concerning amateur stations participating in message forwarding 
  40. systems. The petitioners indicate that 97.103(a) of the Commission's 
  41. rules, 47 CFR 97.103(a), hampers unnecessarily the operation 
  42. of high speed message forwarding systems and repeaters. They 
  43. claim that the potential for transmitting large numbers of messages 
  44. in these systems cannot be achieved because this section does 
  45. not distinguish between the responsibilities of the station 
  46. originating and those only forwarding or repeating violative 
  47. communications. The effect of the proposed rule would be to 
  48. hold the licensee and control operator of the station originating 
  49. the message and the control operator of the first forwarding 
  50. station accountable for communications transmitted within a 
  51. message forwarding system.

  73. Summary of Notice of Proposed Rulemaking
  74.  
  75.    1. This action proposes to amend the rules for the amateur 
  76. service by modifying the Commission's compliance policy for 
  77. stations participating in message forwarding and voice repeater 
  78. systems. The proposed rules are set forth at the end of this 
  79. document.
  80.    2. The proposal contained herein has been analyzed with respect 
  81. to the Paperwork Reduction Act of 1980, 44 U.S.C. 3501 et seq., 
  82. and found to contain no new or modified form, information collection 
  83. and/or record keeping, labeling, disclosure, or record retention 
  84. requirements and will not increase or decrease burden hours 
  85. imposed on the public.
  86.    3. This is a non-restricted notice and comment rule making 
  87. proceeding. See 1.1206(a) of the Commission's Rules, 47 CFR 
  88. 1.1206(a), for provisions governing permissible ex parte contacts.
  89.    4. In accordance with Section 605 of the Regulatory Flexibility 
  90. Act of 1980, 5 U.S.C. 605, the Commission certifies that these 
  91. rule changes would not if promulgated, have a significant economic 
  92. impact on a substantial number of small entities. The Amateur 
  93. Radio Service may not currently be used to transmit any communication 
  94. to facilitate the business or commercial affairs of any party.

  96.    5. This Notice of Proposed Rulemaking and the proposed rule 
  97. amendments are issued under the authority of sections 4(i), 
  98. 303(b), 303(g), and 303(r) of the Communications Act of 1934, 
  99. as amended, 47 U.S.C. 154(i), 303(b), (g), and (r).

  135. participating in a voluntary, cooperative, interactive arrangement 
  136. where communications are sent from the control operator of an 
  137. originating station to the control operator of one or more destination 
  138. stations by one or more forwarding stations.

  141. on a different channel the angle-modulated phone or image emission 
  142. transmission of another amateur station.

  168. that message are accountable for violative communications that 
  169. are transmitted in a message forwarding system. The control 
  170. operators of other stations inadvertently retransmitting violative 
  171. communications in a message forwarding system are not accountable 
  172. for the violative communications.
